One-strike, No Job

SF Gate:

An employer can refuse to hire someone who has ever tested positive for marijuana or other drugs, even if the applicant is now clean and sober, a federal appeals court ruled Wednesday.

That kinda sucks.

Read the article, note the language they use: people who test positive for pot are "addicts", "recovered addicts"; they "need help", they need to "recover". The concept of recreational use is not entertained.

And this from a San Francisco paper.

Update:

Stepped into the first floor men's room on my way out of the office today. Twas full of fume d'herb. I vacated promptly, not wanting to linger in its presence lest someone suspect me of indulging on the job on my third day of employment.

    And if they used the drugs for a medical condition? What then? Many states now allow pot on prescription right?

    not sure how they handle that – it’s not legal for medical uses in NC. but i will guess that if you test positive you’d be asked to provide proof that you have a prescription.

    when i had my scare last year with the codeine cough syrup two days before The Test, the agency said there would be no problem if i could prove it was prescribed. test didn’t show anything, luckily.

    The other one that always gets me is “dangerous drugs.” That’s in the legal language, so as a result it appears in newspaper stories. “Police found 0.5oz of marijuana in the car. Suspect was charged with possession of dangerous drugs.”

    I’m always like, “oh, so besides the weed, they found dangerous drugs too?”
